I.      CALL TO ORDER - 9:00 p.m.

        Chairman Philip Lindquist advised all present that the meeting was being tape recorded and reviewed the agenda for the public hearing. He asked if all abutters had been properly notified and was advised by Administrative Assistant Barbara Ferguson that certified mail receipts for all abutters had been received by the Planning Board office.  Vice Chairman Gerard LeBlanc read the following public hearing notice published in The Enterprise on August 29 & September 5, 2003:

PUBLIC HEARING NOTICE

        The Hanson Planning Board will hold a public hearing on Monday, September15, 2003 at 9:00 p.m. in the Hanson Town Hall, 542 Liberty Street, Hanson, MA on a definitive subdivision plan showing a 7-lot residential subdivision Off Brook Street.  The plan is further identified as Lot 15 on Assessors Map 96. Deed to said property is recorded in Plymouth District Registry of Deeds, Book 24165, Page 330.  The subdivision, entitled Edgewood Estates, is located in Hanson, MA and dated July 31, 2003 by Land Planning, Inc., 1115 Main Street, Hanson, MA 02341.The plan was submitted by R & C Realty Trust, 305 Brook Street, Hanson, MA 02341.
A copy of the subdivision plan is available in the Hanson Town Clerk’s Office and in the Planning Board office for review.

II.     Presentation of plans from applicant/engineer

        Steven Wry of Land Planning, Inc. of Hanson, representing the applicant, told the Board that the 10.5 acre parcel on which the new 7-lot subdivision is proposed was formerly attached to the front parcel.  The property, he noted, is traversed by a Commonwealth Electric easement which is 150 feet in width.  There are no streams or wetlands located on the site.  The project calls for the construction of single family homes.  The roadway will be 40 feet wide with 20 feet of pavement ending in a cul-de-sac.  The property is located in a Residence A District.  Parcel A, he said, will have signage and be landscaped.  The parcel will be turned over to the town when the road is accepted, he said.  The plans call for individual septic systems and underground utilities. He said abutters will be contacted to discuss an easement which would allow the hooking of the water main to a hydrant on Barbara Road to meet the looping requirements of the Water Department.  He said there will be no drainage runoff from the site as it was once a gravel pit.  The plans show a retention basin on Lot 7 with an emergency overflow.

Charles & Winifred Tautkus - Mr. Tautkus said there is vernal pool on Lot 4 and asked whether the developer intended to contour the land so it will not be affected.  Mr. Wry said the lot is on the down side of the slope. Mr. Tautkus also said that survey markers are approximately 10 feet closer to his land and the town’s conservation land than indicated on an existing granite monument.  Mr. Wry said that no staking has been done and no monuments would be touched.

Stephen Costa & Victoria Pasut - Victoria Pasut expressed concern about access to a side road that goes to the conservation area. A fire road to Brook Street has been taken away, she said. Bernard Munro said the cart path is related to another house that is not part of this subdivision. She questioned how the fire department will access the property if there is a fire.

Hubert & Kathleen Monahan - Mr. Monahan complained about the hour at which the hearing was scheduled. He said it prevented a lot of people from coming.  He also asked if there were any plans for access to Barbara Road and Helen Drive other than for water and was told by Mr. Munro that there was not. Mrs. Monahan asked if trees would be cut and was told there would be some grading done to provide new residents with a reasonable back yard.

James Rodick -  Mr. Roderick asked if the developer could keep a buffer up on the hill on Lot 6 and was told that as few trees as possible will be cut.  He also asked about the easement to the hydrant on Barbara Road and was told it will be just wide enough to accommodate the equipment. Some trees will have to be cut within the easement.

Robert & Melissa Mewis - Mr. Mewis said that he was concerned about new neighbors with very small children who live in close proximity to the retention pond and asked if it would be surrounded by a fence. He was told by Mr. Wry that the pond would not be fenced.  The maximum depth in a 100 year storm, he said, would be 2.4 feet and the water would dissipate within 24 hours.

Richard Walsh - Mr. Walsh said that he was concerned about the location of a retention pond on Lot 7 when there is consistently standing water on the site now.  He expressed concern that the excess water will end up in his back yard which is the lowest point in the area. Flooding could extend all the way to State Street, he said. He also asked about the hours of operation and was told they would be written into the order of conditions for the subdivision.

Robert & Mary Lou Sutter - Mrs. Sutter also expressed concern over the retention pond terming it a dangerous attractive nuisance. Chairman Lindquist said that it has been the Board’s experience a fence creates the look of a concentration camp and catches debris making it an attractive nuisance.

IV.     Questions from public

        A question was asked about the hours of operation on Sunday, and Town Planner Noreen O’Toole reiterated that the hours of operation would be in the Certificate of Action.  She said that violations should be reported to the Planning Board office. Working on Sunday, she said, is not permitted.  In response to an earlier comment regarding the lateness of the hour for the hearing, Ms. O’Toole explained that 9 p.m. was the earliest time slot available.

V.      Questions/Comments from other Town Boards/Departments

        A.      Police Department

        Chairman Philip Lindquist read a September 15, 2003 memo from Police Lt. Richard Gredler expressing public safety concerns with the sight distances in both directions on Brook Street regarding vehicular safety.

        B.      Water Department

        Chairman Philip Lindquest read an August 26, 2003 memo from Water Superintendent Glen Doherty indicating that for fire protection the application would need to come before the Board of Water Commissioners.

        C.      Fire Department

        Chairman Philip Lindquist read a September 9, 2003 memo from Fire Chief Allen Hoyt noting that hydrant spacing should be every 300 feet, that there should be a minimum of three hydrants on William Way, and that all cul-de-sacs must have a minimum 50 foot inside turning radius.

        D.      Board of Health

        No questions or comments were received from the Board of Health.
        E.      Building Inspector

        Chairman Philip Lindquist read a September 15, 2003 memo from Building Inspector Michael Kennedy seeking clarification of the intended use and ownership of Parcel A.

        G.      Conservation Commission

        Chairman Philip Lindquist read an August 27, 2003 memo from the Conservation Commission indicating that a Notice of Intent filing would be required as a proposed retention basin is located within the 100-foot buffer zone of a bordering vegetated wetland.

        H.      Highway Surveyor

        No questions or comments were received from the Highway Surveyor.

VI.     Questions from Planning Board Members

        Chairman Lindquist suggested that thought be given to providing access from William Way to the abutting conservation land.  The access from neighboring Audubon Estates, he noted, is by water easement only. He also sought further clarification on Parcel A and was told the current owner would be maintaining the property.  Gordon Coyle said that it looked like a way to skirt around the corner lot provision in the bylaws.

        David Nagle asked if there would be an island in the cul-de-sac.  Mr. Munro said the detailes will be worked out with the Board’s engineer.  The plans currently call for open pavement.

VII.    Comments from Board’s Engineer, John W. DeLano Associates

        The Board reviewed a September 15, 2003 review of the subdivision plans with its engineer on the project, John DeLano of John W. DeLano and Associates, Inc. of Halifax. The letter contained eight recommendations relative to proof of grading and utility easment, a tree planting easement, the future of Parcel A, the installation of a guardrail, spot elevations around the cul-de-sac, a catch basin in the grading easement, the proposed retention basin, and traffic.

        At the meeting Mr. DeLano said that an easement would be one way around the Parcel A issue, recommended a timber post and rail fence in an area where the land slopes, and recommended that a perc test be done in the proposed retention basin to determine the type of soil in light of the concerns voiced by the abutters.  He noted that the basin will ultimately have to be maintained by the town and alternative designs could be considered.
